Terms of Service

These Terms of Service ("Terms") govern your use of the Waveward website and tools at aup4.aivismonitor.com ("Waveward", the "Service"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.

Waveward is operated by Lei Wang, an individual developer. You can contact the operator at vertrigr@gmail.com. Waveward is an independent product and is not affiliated with, endorsed by, or sponsored by Audacity or Muse Group; "Audacity" is used only to name the file formats the Service reads.

The Service

Waveward provides browser-based tools for Audacity project files: .aup4 (Audacity 4), .aup3 (Audacity 3) and the older .aup format (Audacity 1 and 2, together with its _data folder). With them you can open a project, see its tracks and clips, play the mix, export the audio to WAV or MP3, downgrade an .aup4 to .aup3 so Audacity 3.7 can open it again, check a damaged project and recover what can still be read from it. Projects are processed locally in your browser and are not uploaded to our servers, as described in our Privacy Policy.

Free and paid features

Free, with no account: opening a project and playing it in the browser; seeing its tracks, clips and facts (sample rate, blocks, the Audacity version that saved it); exporting the stereo mix to WAV (16-bit or 32-bit float) or MP3 and downgrading .aup4 to .aup3, both for projects up to 256 MB; and running the integrity check with the full recovery report for a damaged project.

A Waveward Pro license adds: rebuilding a damaged project into a clean file Audacity opens; rolling back to an earlier save kept inside the project; exporting a single track on its own, or every track or every clip as separate files in one ZIP; and exporting or downgrading projects larger than 256 MB. The homepage pricing section shows the same split.

License & payment

Waveward Pro is a one-time purchase of $19 (USD) that grants you a personal, non-exclusive, non-transferable license to the paid features. Payment is processed by Creem for purchases made through the existing Creem checkout, in which case Creem acts as the merchant of record. If you choose the Waffo Pancake checkout, Waffo Pancake acts as the merchant of record for that transaction. The provider is identified at checkout and on your receipt; the applicable provider's terms, including Waffo's terms for a Waffo checkout, also apply. After purchase you receive a license key to activate the paid features. This one-time purchase does not create a subscription or an automatic renewal.

If you begin a checkout on Creem's payment page, enter your email address there, and leave without completing the purchase, Creem may send you a small number of reminder emails about that checkout. Those reminders come from Creem, use only the email you entered on its page, and include an unsubscribe link. We may also publish discount codes — for example regional purchasing-power pricing — which apply only when entered at checkout and can be changed or withdrawn at any time.

Refunds

If Waveward Pro does not work as described, contact us at vertrigr@gmail.com within 14 days of purchase and we will work with you and the provider that processed your payment to arrange a refund. A Creem transaction is refunded through Creem; a transaction made through the Waffo Pancake checkout is refunded through Waffo Pancake. Applicable statutory consumer rights are not limited by this policy.

Acceptable use

You agree to use Waveward only with projects you own or are authorised to access, and not to use the Service for any unlawful purpose, to infringe others' rights, or to attempt to disrupt, reverse engineer, or circumvent the Service or its licensing.

Suspension and termination for breach

If you materially breach these Terms, we may restrict or suspend your access to the Service or terminate your permission to use it, including your Pro license. Grounds include using projects without authorisation, using the Service for unlawful purposes or to infringe others' rights, and attempting to disrupt the Service or circumvent its security or licensing. Where reasonably practicable, we will explain the reason and give you an opportunity to remedy the breach before permanent termination. Immediate action may be taken where required by law or necessary to address fraud, abuse or a security risk.

Your locally stored projects remain under your control. These measures do not give us access to your projects or transfer ownership of them. If you believe a restriction is mistaken, contact vertrigr@gmail.com for review. Suspension or termination does not remove any refund right or other remedy you have under applicable law.

Intellectual property

The Service, its software, and its branding are owned by Waveward. These Terms do not transfer any ownership; they grant only the limited license described above. Your Audacity projects and their contents remain entirely yours.

Recovery of damaged projects; "as is"

Waveward's recovery tools work on damaged projects: the free integrity check and recovery report show what is wrong and what can still be read, and Waveward Pro can rebuild the project into a clean file Audacity opens, or roll it back to an earlier save kept inside it. Recovery can only use the data that is still in the file. Audio blocks that cannot be read back are replaced with silence of the same length, and the report lists them; a project whose audio is missing or overwritten cannot be restored in full. We therefore do not guarantee that every damaged project, or every part of one, can be recovered — the report tells you before you buy what a rebuild can use, and the original file is never modified, so keep it. The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose.

Limitation of liability

To the maximum extent permitted by law, Waveward shall not be liable for any indirect, incidental, or consequential damages, or for any loss of data, arising from your use of the Service. Our total liability for any claim relating to the Service shall not exceed the amount you paid for a Waveward Pro license.

Changes to the Service and these Terms

We may modify or discontinue features, and may update these Terms from time to time. Material changes will be reflected by updating the date at the top of this page. Continued use after changes constitutes acceptance of the updated Terms.
